Promotion Rules & Conditions
Method of Entry:
Participants in the energyOn.co.uk Register to Win A "Free Year of Electricity" promotion must sign up for utility service with an energyOn.co.uk utility supplier or register for more information on the energyOn.co.uk website to be eligible to enter the Enter to Wind Free Electricity Sweepstakes. NO PURCHASE OR INTERNET ENTRY IS NECESSARY TO ENTER THE ENERGYON.CO.UK c/o AMERICAN POWER CONVERSION ("APC") [*SWEEPSTAKES*] ("Sweepstakes"). Interested participants may also enter by sending a 3x5 postcard with your name, address and telephone number to: energyOn.co.uk c/o APC., ATTN: Register to Win Free Electicity Sweepstakes, The Aeolian, 4 Mondial Way, Hayes, Middlesex, UB35AR, England. The Sweepstakes begins September 1st, 2002 and all entries must be received before 12:00 a.m. (00:00 GMT) on June 30th, 2003. Only one (1) entry per individual entrant ("Entrant") will be allowed regardless of method of entry.
Entries and Privacy:
All entries will be the property of APC & energyOn.co.uk. Except where prohibited, each Entrant waives any right of privacy or restriction on the registration, use or subsequent disclosure or international transmission of any information contained in the entry, and grants APC & energyOn.co.uk the right to use the information contained in the entry in accordance with the energyOn.co.uk Privacy Policy located at http://www.energyon.co.uk/privacyPolicy.cfm.
Prizes:
Each prize of "free electricity" that will be awarded will have approximate retail value of £200 (pounds). Prizes are non-transferable and are not redeemable for cash. APC/energyOn.co.uk reserves the right to substitute a prize of equal or greater value if the listed prize becomes unavailable.
Drawing:
The random drawing will be conducted each time energyOn.co.uk receives 500 new energy signups by an independent employee of APC/ENERGYON.CO.UK, whose selection" to "The random drawing will be conducted by an independent employee of APC/ENERGYON.CO.UK each time energyOn.co.uk receives 500 new energy signups, whose selection will be final in all matters relating to the Sweepstakes. The Odds of winning will be 500 divided by 1 for each drawing, the number of drawings will depend on the total number of respondents within the specific time period.
Notification:
The winning entrant ("Winner") will be notified by mail after the draw has taken place. Entrants may also periodically check the energyOn.co.uk site for winner postings. The Winner will be required to sign a certificate of eligibility and a document releasing APC from any liability associated with the Sweepstakes, and, where permitted, a document allowing APC to use his/her name, likeness, voice and/or biographical data for advertising and promotional purposes without limitation and without additional compensation within thirty (30) days of notification or the prize will be forfeited and awarded to an alternate Winner. The Winner will be solely responsible for all taxes, license fees, registrations, and/or any other costs, expenses, or requirements related to a prize.
Acceptance:
Except where prohibited, acceptance of a prize constitutes the Winner’s consent to the use of his/her name, likeness, voice and/or biographical data for advertising and promotional purposes without limitation and without additional compensation.
Eligibility:
The Sweepstakes is open to residents of the United Kingdom who are eighteen (18) years of age or the legal age to participate in the Sweepstakes, whichever is greater. Residents or persons located in jurisdictions where the Sweepstakes is illegal or prohibited are not eligible to participate in the Sweepstakes. Employees of APC, its affiliates and subsidiaries, and their shareholders, agents, representatives, contractors, advertising, promotional, and legal advisors, and members of their families are not eligible to participate in the Sweepstakes. Prizes awarded to ineligible participants will be forfeited and awarded to an alternate Winner.
Applicable Law:
The Sweepstakes is subject to all applicable federal, state and local laws and regulations. Any dispute arising in relation to the Sweepstakes will be governed by the laws of Ireland. Each Entrant submits to the exclusive jurisdiction of the courts in the city of Dublin for the resolution of any dispute arising in relation to the Sweepstakes or any prize won.
Disclaimers:
By submitting an entry to the Sweepstakes, the Entrant releases and agrees to defend, indemnify and hold harmless APC, its subsidiaries, affiliates, directors, officers, employees and agents from and against any and all liability for any injury, loss or damage of any kind arising from or in connection with the Sweepstakes or any prize won. APC reserves the right, at its sole discretion:
to disqualify any Entrant who does not comply with the Rules and Regulations set forth herein or any applicable law or regulation, or who tampers with the entry process; and
to cancel, terminate, modify or suspend the Sweepstakes at any time and for any reason. APC is not responsible for any lost, late, misdirected, incomplete, stolen, or illegible entries. APC is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by APC on account of technical problems, human error or traffic congestion on the Internet or at any Web site, or any combination thereof, including any injury or damage to the Entrant's computer or any computer or computer system related to or resulting from participation or downloading any materials in the Sweepstakes.
Winner:
For the Winner’s name, please send a self-addressed stamped envelope by June 30, 2003, to: energyOn.co.uk c/o APC UK Ltd., ATTN: Winners List -- Enter to Win Free Electricity Sweepstakes, The Aeolian, 4 Mondial Way, Hayes, Middlesex, UB35AR, England.
THE SWEEPSTAKES IS VOID IN ANY COUNTRY, TERRITORY, STATE, PROVINCE, REGION OR ANY OTHER SUCH JURISDICTION WHERE THE SWEEPSTAKES IS PROHIBITED BY LAW, AND TO THE RESIDENTS THEREOF AND PERSONS LOCATED THEREIN.
